This document (together with all the documents mentioned therein) establishes the general conditions (hereinafter, the "General Conditions") governing the use of the website www.cibervoluntarios.org (hereinafter, The "Website"). The use of the Website does not entail the mandatory registration of the user (hereinafter, the "User"). The conditions of access and use of the Website are strictly governed by current legislation and by the principle of good faith, and the User undertakes to make good use of the Website. We ask the User to carefully read these General Conditions, our Privacy Policy and our Cookies Policy before using this website.
These General Conditions could be modified. It is your responsibility to read them periodically, since those that are in force at the time of placing orders or in the absence of these, at the time of use of the Website, will be those that are applicable.
On the one hand, the provider of the services offered through the Website is FUNDACIÓN CIBERVOLUNTARIOS, with address at calle Pedro Unanue 14, local - 28045, Madrid (Spain), with V.A.T. No. G-84410158 (hereinafter, "Cibervoluntarios") and on the other, the User who may or may not be registered. A User can be registered as a volunteer or as an entity, and in both cases they will be registered through email and password, over which the Users will have full responsibility for use and custody, being responsible for the veracity of the personal data provided to Cibervoluntarios.
Cibervoluntarios is a non-profit entity made up of social entrepreneurs that promotes the use and knowledge of new technologies as a means to alleviate possible social gaps, generate social innovation and provide citizen empowerment. Cibervoluntarios works to increase the rights, opportunities and capacities that each person has within their environment, thanks to the social use of technological tools and applications that are within their reach.
The purpose of these General Conditions is to regulate the relationship between Cibervoluntarios and Users who register as volunteers to offer, together with Cibervoluntarios, the services offered to entities that register to receive the services offered by Cibervoluntarios.
To access certain functions of the Website and other elements of services offered by Cibervoluntarios, the User will have to create an account in Cibervoluntarios. The User may create an account as a volunteer or as an entity. When creating an account, the User must provide correct, truthful and complete information. It is important that Users keep their Cibervoluntarios account password secure and confidential. The User agrees to be solely responsible for all activity that takes place in his Cibervoluntarios account.
The User may register as a volunteer (hereinafter “Volunteer”) at the “Join” section of the Website. To do this, the User must provide an email and create a password that will be personal and non-transferable, with the Volunteer being solely responsible for maintaining its confidentiality.
Volunteers are agents of social change and will offer free advice and training to people who, for reasons of gender, age, professional environment, educational level, lack of material or economic resources or others, are at risk of socio-digital exclusion and with the objective to adapt the use of technological applications and alleviate possible social gaps.
For the purposes of the provisions of article 8, points 4 and 5, of the Voluntary Law 45/2015, of October 14, the User who wishes to register as a Volunteer certifies not having a criminal record for crimes of domestic or gender violence , for attempting against the life, physical integrity, liberty, moral integrity or freedom of sexual intimacy of the other spouse or of the children, or for the crime of drug trafficking or clandestine immigration of personnel, or for crimes of terrorism, through this responsible statement.
For the cases in which the Volunteer must intervene in an activity in which they interact or are in contact with minors, the Volunteer, before the activity takes place, will certify that he/she has not been convicted by a final sentence for crimes against freedom and sexual intimacy, trafficking and exploitation of minors through the provision of a negative certification that can be obtained in Spain through the Central Registry of Sex Offenders , or any other similar valid document in force from the country of origin. Such certification will be sent through the Cibervoluntarios extranet or by email to Cibervoluntarios at fundacion@cibervoluntarios.org.
Under age users can get the status of volunteers provided that their superior interest is met in accordance with the current legislation and they also comply with the following requirements:
People over 16 and under 18 shall require the consent of parents, guardians or legal representatives. From then on they will have the same rights and duties than the rest of volunteers within the entity.
Minors under the age of 16 requesting to become volunteers is not covered within the entity.
The Volunteer must access Cibervoluntarios extranet to know all the activities in which they can participate and where they can collaborate. In case of participating in any of the activities organized by Cibervoluntarios or providing any of the services offered by Cibervoluntarios, the Volunteer acknowledges that they will be able to find all the material they need, as well as the details of the activity or service, on the Cibervoluntarios extranet, by accessing through the Website. In case a Volunteer cannot access the extranet for any reason, the Volunteer accepts that Cibervoluntarios contact him/her via WhatsApp.
In the event that an entity wants to benefit from the free activities and services offered by Cibervoluntarios, they must register in the “Request” section of the Website as an entity (hereinafter, "Entity"). Cibervoluntarios collaborate with organizations of all kinds that want to help groups at risk of socio-digital exclusion.
In order to correctly register the Entity, the fields indicated in the registration form must be filled out. In the registration form, the name and address of the Entity, the person responsible within the Entity, the position they occupy, their email and a telephone number must be filled in. Lastly, the Entity's contact person must select the type of activity they wish to carry out among a selection (talk, conference, creation / adaptation of materials, course, event, training, initial training, other, workshop or webinar) and choose the subject matter among the available options (educational support, apps, electronic banking, blog, search engines, etc.).
The Entity must provide the title that it wishes to give to the activity and provide a brief description of it. Likewise, to facilitate the work of the Volunteers and Cibervoluntarios, the Entity must indicate the group of attention to which the activity would be destined and their level of knowledge, as well as the hours of duration, the schedule and the number of people who would initially attend.
In the event that the Entity does not find an activity among the possible options on the Website, it may contact Cibervoluntarios through the email fundacion@cibervoluntarios.org. The Entity agrees to receive information from Cibervoluntarios about its activity and project through WhatsApp, as well as to receive news and publications similar to the project it will carry out.
Once the registration process on the Website has been completed, Cibervoluntarios will contact the Entity to organize the activity. Likewise, the parties will sign an agreement that regulates the specific conditions applicable to the activity that Cibervoluntarios will carry out together with the Volunteers. The Entities undertake not to contact the Volunteers directly or to collect their data, always respecting the intermediation of Cibervoluntarios.
Users who wish to do so may collaborate with Cibervoluntarios by contributing financially through a donation. To make voluntary donations to Cibervoluntarios, Users must access the “Support our actions” section of the Website. Users may make a donation in two different ways: either (i) making a single donation (one-time payment) or (ii) making periodic donations (quarterly, semi-annually or annually), by becoming a member.
Single Donation: Users must select the desired economic amount to make on time. To do this, they must mark the amount they wish to donate among the available options (10 Euros, 20 Euros or 50 Euros) or include another economic amount of their choice.
After selecting the economic amount that the User want to donate, the User must select whether he is a private individual or a company and fill in all the identifying information such as name and surname, identification document, telephone number and email. Once all the data have been filled in, the User will click on “Donate” and can make the payment through the online virtual POS payment system. Users will be automatically redirected to the secure online payment platform system of the Bankia financial institution, where the user's credit or debit card (VISA, MasterCard) details such as the card number, expiration date and the security code.
Periodic Donation: Users can become members and make a periodic donation choosing both the frequency (monthly, quarterly, semi-annually or annually) and the financial amount to contribute among the available options (10 Euros, 20 Euros or 50 Euros) or include another amount of their choice.
After selecting the economic amount and the frequency, the User must select whether the User is an individual or a company and fill in all the identifying data such as name and surname, identification document, telephone number and email. Once all the data has been filled in, the User will click on “Become a member” and will be able to make the payment through the online virtual POS payment system. Users will be automatically redirected to the secure online payment system of the Bankia financial institution, where the User will be requested the data of the User’s credit or debit card (VISA, MasterCard), such as the card number, expiration date and the security code.
In this case, as it is a periodic donation, payment will be made automatically and associated with the credit card provided at the time of the first donation.
The User has the right to deduct donations in the income tax return (IRPF in Spain) or in the corporation tax declaration if the User is a legal person. For this, Cibervoluntarios may issue the corresponding donation certificate that will be sent by postal mail to the address that the User has indicated when requesting said certificate.
Cibervoluntarios guarantees the protection and confidentiality of personal data, payment data and any other type provided by donor Users in compliance with the applicable regulations on data protection.
As it is an unconditional donation intended for the general purposes of Cibervoluntarios, the realization of said donation does not entail the delivery of any product or service, nor there is the right of withdrawal, as established by Law 7/1996, on the Regulation of Retail Trade and Law 3/2014, dated March 27, which modifies the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, dated November 16.

The Volunteer grants to Cibervoluntarios on a non-exclusive basis all the rights that may correspond to said Volunteer on the use of the content recorded on his voice and image due to the activities and projects he/she performs for Cibervoluntarios and in the performance of the functions entrusted to him/her in by virtue of his/her relationship with Cibervoluntarios, free of charge and under the provisions of Organic Law 1/1982 of May 5, on Civil Protection of the Right to Honour, Personal and Family Privacy and Self-Image.
The use of these rights that are transferred here will be promotional, without any time or geographical limit. In particular, Cibervoluntarios may reproduce, distribute and / or publicly communicate the images of the Volunteers or part of them in all countries of the world, through any means or medium currently known or that may be developed in the future, within the framework and with the necessary scope for the regular exercise of Cibervoluntarios.
The use by Cibervoluntarios of the voice and images of the Volunteers will in no case constitute or be considered as illegitimate interference with their privacy.
The Entities with which Cibervoluntarios carry out projects and other training activities ensure and guarantee that they will obtain, from all the participants, the consent for the transfer of all the rights that may correspond to them on the use of the recorded content on their voice and image. and that they will be transferred to Cibervoluntarios on a non-exclusive basis and without any time or geographic limit.
All the information provided by the Users of Cibervoluntarios will be used in accordance with the provisions of the Privacy Policy and the Cookies Policy. .
The personal data received will be treated in accordance with the provisions established in Regulation 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of these and by which Directive 95/46 / EC (General Data Protection Regulation) and Organic Law 3/2018, dated December 5, on the Protection of Personal Data and guarantee of rights are repealed. digital (LOPD-GDD) and other concordant regulations in force in Spain.

All the contents of the Website, unless otherwise indicated, are the exclusive property of the Website owner or third parties and, by way of example, but not limited to, the graphic design, source code, logos, texts, graphics, illustrations, photographs, and other elements that appear on the Website. Likewise, all trade names, brands or distinctive signs of any kind contained on the Website are protected by law.
The owner of the Website does not grant any type of license or authorization for personal use to the User regarding their intellectual and industrial property rights or any other right related to their Website and the services offered therein. For this reason, the User acknowledges that the reproduction, distribution, marketing, transformation, and in general, any other form of exploitation, by any procedure, of all or part of the contents of this Website constitutes an infringement of intellectual and/or industrial property rights of the owner of the Website or the owner of said rights.
The intellectual property of the images of the Users referred to in point 6 of these General Conditions is considered assigned to Cibervoluntarios under the consent of the User contained in said section. Specifically, the User will transfer exclusively to Cibervoluntarios, for everyone and for the maximum time legally allowed, all intellectual property rights, including those of reproduction, distribution, public communication (including making available) and transformation, which may correspond to the User on the content of the images, along with the right to make improvements, modifications or works derived from the foregoing, free of any encumbrance or restriction, for use in any medium. This includes, but is not limited to, the right to distribute, publish, display, digitize, present, retransmit, transfer, display and use all types of content that may arise.
Cibervoluntarios will only be liable for the damages that the User may suffer as a result of the use of the Website when such damages are attributable to a malicious act of Cibervoluntarios. The User acknowledges and accepts that the use of the Website, as well as the commissioning of projects, training sessions and other activities offered therein is carried out at his/her entire risk and responsibility.
Cibervoluntarios is not responsible for the damages that may derive from, merely by way of example and not limitation: (i) Inferences, omissions, interruptions, computer viruses, breakdowns and / or disconnections in the operational operation of this electronic system or in the Users' computer devices and equipment, motivated by causes beyond Cibervoluntarios, that prevent or delay the provision of services or navigation through the system; (ii) Delays or blockages in use caused by deficiencies or overloads of the Internet or other electronic systems; (iii) That they may be caused by third parties through illegitimate interference outside the control of the Website and that are not attributable to Cibervoluntarios; (iv) The divergences of the information, documentation and / or other content of the Website that may exist between the electronic version and the printed version, if any; (v) The impossibility of providing the service or allowing access for reasons not attributable to Cibervoluntarios, due to the User, third parties, or force majeure.
Cibervoluntarios does not control, in general, the use that Users make of the Website. In particular, it does not guarantee under any circumstances that Users use the Website in accordance with the law, these General Conditions, generally accepted morals and good customs and public order, nor that they do so diligently and prudently.
By using this Website, the User agrees that most of the communications made with Cibervoluntarios are electronic. Cibervoluntarios will contact the User by email or, in case the User is registered as a Volunteer or as an Entity, through the Cibervoluntarios extranet. Likewise, Volunteers and Entities agree to receive communications from Cibervoluntarios via WhatsApp with the sole objective of guaranteeing correct communication between the parties.
Cibervoluntarios reserves the right to proceed with the content modifications, updates, changes and configuration that are necessary in these General Conditions, not assuming any type of responsibility for the modifications, updates, changes and configuration of both these General Conditions and the Website.
These General Conditions are governed by current Spanish legislation. Specifically, they are subject to the provisions of Royal Legislative Decree 1/2007, dated November 16, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws; Regulation (EU) 2016/679 of the European Parliament and of the Council, dated April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of these data and by which Directive 95/46 / EC is repealed; Organic Law 3/2018, dated December 5, on the Protection of Personal Data and guarantee of digital rights; and Law 34/2002 dated July 11, on Information Society Services and Electronic Commerce as well as any other Law or Regulation that develops or modifies them and other complementary legislation.
For the resolution of any controversy or conflict arising from these General Conditions, the Courts and Tribunals of Madrid will be competent, the User expressly renouncing any other jurisdiction that may correspond.
